The General Terms and Conditions of Use and Contracting aim to regulate the information provided in the aresta.com online shop, as well as the transactions between it and its users. By browsing the online shop and purchasing any of its products as a user, you are accepting these General Conditions of Contracting. aresta.com can modify the site to make the necessary changes and modifications for the proper use of it without prior notice.

The user agrees to these conditions, as well as to follow the instructions of the website, abide by the law and act morally and in good faith.

Minors are not allowed to use the portal without their parents' consent. aresta.com is not responsible for the accuracy of the users' data and therefore cannot verify their age.

3. Pricing

All retail prices of our products include taxes. Depending on the country the shipment is sent to, taxes may apply. The final price, with taxes broken down, is shown in the shopping basket.

VAT is the Value Added Tax that applies to goods sold by Aresta Sport i Aventura, S.L. within the European Union (EU).

In the European Union member territories, VAT rate is 21%. Such VAT will be itemized in the invoices sent (within the same package or as an e-mail attachment). Companies belonging to European Union countries (except Spain) will be exempt from VAT as long as they are registered as intra-Community operators.

Andorra, Gibraltar, the Canary Islands, Ceuta, and Melilla are considered non-EU territories due to their particular tax regime and, therefore, prices there shall be exempt from VAT. Customs expenses (SAD) and import taxes are not included in the item price or the shipment and shall be borne by the receiver of the goods.

Prices displayed in aresta.com can be revised and modified at any time if conditions so require.

 

Flash Offer / Offers

All products sold at a special price will be displayed on the website with the following information: Flash price, regular price, discount rate and end of offer date. These offers are available until the date shown, or until end of stock, and then the product will automatically disappear from the web.

Flash Offers cannot be combined with other offers, packs, discounts or special promotions in effect.

All packs are considered special promotions and are not subject to any other discount.

 4. Payment

Aresta Sport i Aventura, S.L. is the owner of the goods shipped until full payment of them by the customer. The website will show payment methods available for your order.

Payment possibilities are:

 

Credit or debit card

Aresta Sport i Aventura, S.L. fully guarantees the security of the payment information provided. This information in sent encrypted in a secure environment. These data go directly to the POS (Point of Sale) of the bank and is never recorded in our database.

In a constant effort to achieve greater security in payments by credit card, our payment gateway offers SEC secure payment (Secure Electronic Commerce), a solution promoted by Visa, MasterCard, Microsoft, Netscape, etc. to find safer mechanisms to increase users' and businesses' confidence.

From now on, in addition to the card number, expiration date and validation code (the last three digits of the number printed in italics on the back of your card), an additional password will be required, which is a four-digit secret key used exclusively to make purchases over the Internet and which unequivocally identifies the owner of the card. This way, your own bank (the bank that issued the card) can identify you before accepting any debit and thus ensure the safety of your online shopping.

To obtain this key, you should contact the bank that issued your card. Many banks allow online activation of the key, provided that you are client of its online banking service.

Aresta Sport i Aventura, S.L. allows payment only to users of Visa or MasterCard cards using this system. If in doubt, contact your bank.

ATTENTION: Credit card fraud is a crime and Aresta Sport i Aventura, S.L. will report any attempt of fraudulent transaction in our online store. Aresta Sport i Aventura, S.L. is obliged to take all possible measures so that those who make fraudulent purchases are punished by law.

 

Bank transfer

If the customer so desires, it is possible to pay the purchase by bank transfer. The order confirmation e-mail will indicate the Aresta Sport i Aventura, S.L. bank account number where purchase amount should be transferred.

When making the transfer, it is very important to state order number and buyer's full name.

Once the order is placed, the buyer will then have a 3-day term to set up the transfer and notify it to aresta.com. An email must be sent to tienda@aresta.com indicating buyer's full name, order number and amount transferred. You can also send the transfer confirmation by fax to (+34) 972 27 44 71.

The order will not be considered formalised until we receive the proof of payment by fax or email.

All payments must be made in full and in Euros. All possible fees or expenses shall be borne by the customer. For bank transfers made from outside Spain, it is very important to tell the bank that the customer will pay all commissions at origin, such as any bank commissions or charges corresponding to his or her entity. Otherwise, Aresta Sport i Aventura, S.L. could stop delivery of the order until full payment is received.

 

PayPal

If the client so wishes, payment can be made through Paypal, a secure payment system (using a credit card or a bank account) that uses an account linked to this platform and with an intermediary that ensures greater protection, both of data and against possible cases of fraud.

PayPal allows consumers with an e-mail address to send online payments in a safe, convenient, cost effective way and protects buyer's details (the seller receives payment without knowing the buyer's bank details).

Cash on delivery

If the client so wishes, payment can be made cash on delivery upon reception of goods (mainland Spain and Balearic Islands only). The payment will be in cash upon order delivery by the carrier.

In case of purchases of a significant amount, an express order confirmation by the customer is needed.

There will be a 3% management fee on the total value of the purchase, due to the manual procedures needed to process these orders. To avoid this fee, payment by credit card (immediate and at no additional cost) is recommended. This 3% fee is applied to each order, not to each item.

This payment method is not valid for order collection at Aresta Girona and Aresta Olot stores.

 5. Product features and photos

Product prices, photos, technical characteristics, services and accessories can be modified at any time without previous notice.

In many cases, images are supplied by the brand itself, but some of them are made by our Graphics Department. As the article arrives in our warehouse in different deliveries over the year, it may be that the product itself slightly differs from the image on the web.

Aresta Sport i Aventura, S.L. guarantees that the article delivered will be the most recent one and that it will display the same features.

6. Product guarantee

Aresta Sport i Aventura, S.L. clients benefit from the 2-year legal guarantee for new articles and from the manufacturer's warranty on all their articles (if the latter covers a longer period). For certain products (such as watchbands and batteries), the guarantee period is 1 year.

Warranties only apply if the product has been correctly used according to its technical specifications. Warranties do not cover damages due to misuse, normal wear and tear, negligence, incorrect washing, accident, and alteration or modification of the product.

If the Aresta Sport i Aventura, S.L. client wants to send us a product under warranty they must first contact us. No product will be accepted without prior notice.

We will contact you via email or phone to arrange the collection of the product by our transport agency.

A parcel must be prepared with all the product documentation, a copy of the purchase invoice and the warranty. The packaging used must ensure that the shipment arrives in good condition.

Once the product is checked:

a) If the warranty is accepted: the entire management of the warranty is exempt from payment of transport costs. Aresta Sport i Aventura, S.L. will immediately send you another product or will refund you the full amount as follows:

. If the payment was made cash on delivery or by bank transfer, the amount will be reimbursed to the account number you indicate us.

. If the payment was made by credit card, the amount will be reimbursed to the same credit card.

When making the reimbursement, Aresta Sport i Aventura, S.L. will send a proof by e-mail or fax.

If the customer does no want the money to be reimbursed, a client voucher can be created in their customer file to be spent on future purchases.

b) If the warranty is not accepted: Aresta Sport i Aventura, S.L. will propose a possible repair or will try to find the best solution. Any repair is subject to customer's acceptance of the estimate, which will reflect all possible expenses. In this case, all shipping costs will be borne by the customer.

Aresta Sport i Aventura, S.L. undertakes to make all necessary arrangements to repair, credit or replace the defective product as soon as possible.

Before making any purchase, we recommend you to find out about the quality level of the items you want to purchase, since some products' performance level may decrease with use. Obviously, this loss of function is not covered by the warranty. 7. Product delivery problems

Notwithstanding the right of withdrawal and the guarantee for non-compliant products, the circumstances that can cause an impact on the delivery of your product are:

a) Product damaged by transport: If, at the time of collection or delivery of the product, any damage in the packaging or product is detected, it must be reflected in the carrier's POD (proof of delivery) and you must contact aresta.com within seven days to report the incident. aresta.com shall bear the costs of collecting the damaged product and delivering the order, whenever possible. If it is not possible to supply the same product and the customer does not want to replace it with another one, we will proceed to refund the amount previously paid.

Product that does not correspond to the order: it must be reported within 14 calendar days. Aresta.com will bear the cost of collecting the wrong product and of delivering the one corresponding to the order placed. If it is not possible to supply the same product and the customer does not want to replace it with another one, we will proceed to refund the amount previously paid.

8. Delivery conditions and charges

Delivery times always refer to business days, from Monday to Friday, and may be affected by local or national holidays. If the chosen payment method is bank transfer, these times may be modified, since the order will be shipped only after confirmation of the bank transfer or proof of payment has been received. Aresta Sport i Aventura S.L. accepts no liability when delivery times change for causes outside our control.

 

  • In-shop pick up (Aresta Olot or Aresta Girona)

You can pick up your order in our stores in Girona and Olot with no freight charges. You must select this pick-up method during the purchase process. Aresta will notify the customer once the item or items have reached the chosen store.

 

  • Home delivery in mainland Spain

We offer two different services: ASM 24-hour service and ASM 10-hour service (depending on customer's preference).

In both cases, Aresta Sport i Aventura S.L. guarantees delivery to the carrier on the same day the order is placed, provided that this is formalized before 14:00 pm (mainland Spain time) on any working day. Otherwise, the order will be processed on the first working day following the day of its placement. Products must be "in stock" and payment has to be confirmed. With the ASM 24-hour service, the order will be delivered on the next working day (before 18.00), and with the ASM 10-hour service the order will be delivered before 10.00 on the next business day.

 

It should be noted that orders paid by bank transfer will be prepared upon reception of payment confirmation from our bank (or upon reception of proof of payment).

If the order includes skis, their assembly can usually be done within the same day of the order, but it has to be confirmed in each case, depending on the time of receipt of the order and the availability of all necessary information to carry it out.

It must be made clear that orders delivered cash on delivery are subject to a 3% charge over the sale price (delivery charges included).

Due to their weight, volume and size, canoes and pavilions are excluded from these delivery conditions. They can only be bought for delivery in peninsular Spain and delivery time and expenses will be confirmed for each individual order. 24-hour delivery time will not always be possible.

 

  • Home delivery to Balearic Islands

We offer ASM 24-hour/48-hour service.

Aresta Sport i Aventura S.L. guarantees to deliver the items to the carrier on the day the order is placed, provided that this is formalized before 14:00 pm (mainland Spain time) on any working day. Otherwise, the order will be processed on the first working day following the day of its placement. Products must be "in stock" and payment has to be confirmed. With the ASM 24-hour service, the order will be delivered within 24 or 48 hours.

It should be noted that orders paid by bank transfer will be prepared upon reception of payment confirmation from our bank (or upon reception of proof of payment).

If the order includes skis, this period may be exceeded because they may require a special shipment (however, delivery charges will not change). Moreover, their assembly can usually be done within the same day of the order, but it has to be confirmed in each case, depending on the time of receipt of the order and the availability of all necessary information to carry it out.

  • Home delivery to Canary Islands, Ceuta and Melilla

The carrier used for these shipments is Correos. The approximate delivery time to the Canary Islands is 8 days, and to Ceuta and Melilla is 4-5 days.

Aresta Sport i Aventura S.L. ensures that items will be delivered to the post office on the next day after the order is placed, provided that this is formalized before 14:00 pm (mainland Spain time) on any working day. Otherwise, the order will be processed on the first working day following the day of its placement. Products must be "in stock" and payment has to be confirmed

It should be noted that orders paid by bank transfer will be prepared upon reception of payment confirmation from our bank (or upon reception of proof of payment).

Sales to the Canary Islands, Ceuta and Melilla are VAT (21%) exempt.

Due to their weight, volume and size, canoes and pavilions cannot be sent to the Canary Islands, Ceuta and Melilla. Parcels can measure up to length + height + width = 210 cm, provided that the longest dimension is not longer than 100 cm.

Customs charges and import taxes are not included in delivery charges and are to be paid at destination. We can never determine the amount of this tax.

If the order includes skis (shorter than 100 cm), their assembly can usually be done within the same day of the order, but it has to be confirmed in each case, depending on the time of receipt of the order and the availability of all necessary information to carry it out.

Otherwise, the order will be processed on the first working day following the day of its placement. Products must be "in stock" and payment has to be confirmed. With the ASM 24-hour service, the order will be delivered within 24 hours.

This deadline applies to major Portuguese cities, while in all other cities delivery will be made within 48/96 hours.

It should be noted that orders paid by bank transfer will be prepared upon reception of payment confirmation from our bank (or upon reception of proof of payment).

If the order includes skis, their assembly can usually be done within the same day of the order, but it has to be confirmed in each case, depending on the time of receipt of the order and the availability of all necessary information to carry it out.

  • International deliveries

We offer the ASM 3 to 5-day service.

There are two zones for international shipments:

Zone 1 includes the following countries: France, Germany, Italy, Belgium, United Kingdom, Netherlands, Luxembourg, Austria, Ireland and Northern Ireland. (We do not serve in Corsica or Sardinia.)

Zone 2 includes the following countries: Denmark, Czech Republic, Switzerland, Greece, Finland, Sweden, Poland, Romania and the rest of the EEC.

In both zones we offer two services: ASM 3 to 5-day service and ASM XXL 3 to 5-day service, the latter for items that weight more than 20 kg or with a volumetric weight of XXXX.

The exact amount of freight charges of the ASM 3 to 5-day XXL service is calculated based on the weight of your order. You can view it directly in the basket before confirming the order.

Shipping costs do not include additional charges for taxes and customs, which shall be borne by the receiver of the goods.

Payment is always in Euros and we cannot assume any responsibility for possible variations in exchange rates (whether in the client's or our favour).

9. Returns and exchanges

If, for any reason, the customer is not satisfied with a product, they have the right to exchange it for another (different item, different size or different colour) or return it.


Returns


The product must be in perfect condition, with all its labels, manuals, instructions, warranties and original packaging. Under no circumstances will items be accepted if they show signs of having been used.

All items returned in conditions unfit for sale will be returned to the client.

You must fill in the form found under the RETURNS section in aresta.com, and you will receive an e-mail with a summary of the refund requested and a reference number from Aresta, that needs to be indicated in the package.

Delivery costs will be borne to the customer. No returns will be accepted with unpaid postage. Refunds can be made by any means the client decides (mail, carrier, etc.). The packaging used must ensure that the shipment will arrive in perfect conditions.


To facilitate the management of the refund, Aresta Sport i Aventura S.L. provides the RETURN article, a service that is available on our web (at a price of EUR 20/50, depending on the zone*) with which we will arrange the collection of the product. You will only need to prepare the product for collection and indicate us the address and the pick-up times. The shop will take care of everything. If you want to process a return, click here.

 

After checking the product and accepting the return, Aresta Sport i Aventura, S.L. will refund the payment immediately. The amount paid will be returned as indicated below:

. If you paid cash on delivery or by bank transfer, the amount will be transferred to the account number provided.

. If the payment was made by credit card or PayPal, the amount will be credited to the same card.

IMPORTANT: Please do not put tape or stickers directly on the box; you must wrap the product first.

Return Form

 

Changes

If you want to return a product and replace it for another one, please contact us. No item will be accepted if we have not been previously informed. We will contact you by e-mail or telephone at the telephone number you specified.

You must fill in the form found under the RETURNS section in aresta.com, and you will receive an e-mail with a summary of the refund requested and a reference number from Aresta, that needs to be indicated in the package.

If the product change is due to an error in the preparation of the order or in the transportation, all shipping costs will be borne by Aresta Sport i Aventura, S.L.

For other changes, delivery charges from the customer to Aresta Sports i Aventura, S.L. and from Aresta Sports i Aventura, S.L. to the customer will be borne by the customer. No changes will be accepted at our expense.

To facilitate the management of the change, Aresta Sport i Aventura S.L. provides the CHANGE article, a service that is available on our web (at a price of EUR 20/50, depending on the zone*) with which we will arrange the collection of the product. You will only need to prepare the product for collection and indicate us the address and the pick-up times. Once we verify that everything is correct, we will send the new item. The change will be accepted once it is checked that the product is in perfect condition, with all its labels, manuals, instructions, warranties and original packaging. Under no circumstances will items be accepted if they show signs of having been used

IMPORTANT: Please do not put tape or stickers directly on the box; you must wrap the product first.

Fill in the following form indicating the new product you want to change the item purchased for. If the change is not possible, Aresta Sport i Aventura S.L. will notify the customer as soon as possible.

10. Right of withdrawal

 

If you are not satisfied with the products purchased at aresta.com, you have the right to withdraw from the contract by returning your purchases at any store (Girona or Olot) or through our online store, as explained below.

. Withdrawal period: You can withdraw from this contract without justification within 14 days from the date of purchase.

If you purchased several items on the same order and these are delivered separately, the withdrawal period will end 14 days from receipt of the last item.

. Exercise of the right of withdrawal: In order to exercise the right of withdrawal, you must clearly notify the decision to withdraw from the contract in any of the following ways:

 

* If you choose to return the product to any of our physical stores Aresta, you must submit the invoice.

* If you choose to return the product through our online store, you will first need to contact us by phone at 0034 972 273 500 or by sending an email to atc@aresta.com to inform us about your unequivocal decision to withdraw from the contract.

* Notwithstanding the two preceding paragraphs, you may exercise your right of withdrawal using the form below and sending it by email to atc@aresta.com. You will be notified when the withdrawal is received.

The right of withdrawal shall be exercised within the stated period once we have sent you a communication concerning the exercise of this right before the end of the corresponding period, according to the stated terms.

 

. Consequences of withdrawal: In case of exercising the right of withdrawal, all payments made by you will be refunded, including delivery charges (excluding additional costs if you chose a delivery method which is different than the less expensive one that we offer), without any delay and, in any case, not later than 14 calendar days from the date on which you inform us of your decision to withdraw from this contract.

The refund will be processed using the same means of payment used to pay for the order (without incurring any additional expenses).

The refund will be withheld until receiving the goods purchased.

In all cases, products subject to reimbursement must be in perfect condition, sent in their original packaging and with all manuals, accessories or promotional gifts. Otherwise, you will not be entitled to exercise your right of withdrawal.

The right of withdrawal regulated in this section applies exclusively to products purchased through www.aresta.com, and will shall not be applicable in respect of those products purchased at the Aresta stores.

11. Responsibility

All adventure sports, climbing, biking, skiing, snowboarding and other activities that taking place in the mountains, as well as vertical work, are high-risk activities, with significant dangers to health and life. It is the responsibility of the customer to be technically qualified to use the different products that Aresta Sport i Aventura, S.L. distributes.

When skis are bought, assembly is adjusted according to the information given in the purchase. However, both height and length of the boot may vary due to wear or other reasons. The DIN setting is the recommended one according to user's weight. It is advisable to check the boot pretension with a specialist, or you can contact us.

Aresta Sport i Aventura, S.L. disclaims any liability for damages caused by the use of products supplied, including cases where the material has been used correctly.
